Platform Rules | Lux et Ars

1) Scope & Eligibility

Rules apply to all features (accounts, uploads, auctions, purchases, certificates, profiles, messages).
You must be 18+ to create an account and use marketplace features.
Using the platform also means you agree to our Terms and Privacy Policy.

Lux et Ars focuses on artist-directed, AI-assisted works. We protect creators, subjects, and collectors.

Allowed: AI-assisted art with meaningful human direction/finishing; pure AI pieces with clear disclosure.
Prohibited: illegal content; hate or extremist propaganda; explicit sexual content involving minors or young-looking persons; doxxing; incitement to violence; malware; non-consensual intimate imagery; impersonation or deceptive “deepfakes”.
IP & Persona: Don’t infringe trademarks, copyrighted material, or privacy/publicity rights. Avoid misleading “by [living artist]” claims. Stylistic inspiration is fine; passing off as another living artist is not.
Authenticity: No mass-spam, auto-generated junk, keyword stuffing, or misleading thumbnails.
Disclosure: Mark “pure AI” vs. “AI-assisted” in the upload form truthfully.

Quality Honesty No Abuse

Document your creative process to help collectors assess originality and quality (especially for exclusive licenses).

Metadata: title, description, tags, category.
Process (recommended / AAML-relevant): prompt history, editing steps, intermediate images/screens, tools you used.
Exclusivity: If you promise exclusivity, the asset must not be listed elsewhere. We may ask for proof.
Files: upload high-res master; watermarks/previews are handled by the platform.
Provenance: Each sale issues a certificate; verification at /verify-certificate.

Missing or misleading documentation can lead to removal or reduced visibility.

We support the AI Artwork Master License (AAML) for exclusive works and an AI Art Data License for pure-AI usage rights.
Transfers of exclusive licenses must occur through the platform so provenance stays intact. See FAQ and Commission.
After a completed transfer, the previous owner’s rights cease. One license owner at a time.
All purchases and transfers are logged with a unique license ID and certificate.

Binding: Bids and Buy-Now purchases are binding. Set correct amounts and currencies.
No manipulation: No shill bidding, bid shielding, artificial price inflation, or collusion.
Timing: Auctions run on the scheduled clock; late bid extensions (if enabled) are applied automatically.
Fees & Taxes: Our commission applies per sale (see Commission). Buyers are responsible for applicable taxes (e.g., VAT) at checkout.
Refunds: Digital deliveries are generally non-refundable once accessed, unless required by law.

We use a mixture of proactive review and reports. Actions depend on severity and history.

Level	Examples	Typical Action
Warning	Low-grade spam, missing metadata, minor mislabeling.	Content edit/removal, notice on account.
Strike	Repeated mislabels, deceptive thumbnails, light IP issues.	Strike on account (visible in settings), temporary feature limits.
Severe	Shill bidding, hate content, doxxing, fraud, explicit illegal content.	Immediate removal, suspension or ban; evidence preserved.

Accumulating 3 strikes within 180 days may lead to suspension. Severe violations can skip directly to a ban.

Payments are processed through vetted providers. Never send money off-platform.
For higher-value transactions or payouts we may request KYC/AML verification as required by law.
Suspicious activity can trigger holds or reviews to protect buyers, sellers, and the platform.

We respect your privacy. See our Privacy Policy and Cookie Policy. Do not include sensitive personal data in artwork descriptions or prompts.

Report violations via /contact or the report link where available.
You can appeal moderation actions within 14 days. Provide context and evidence.
We may adjust these rules; material changes are announced on /news.
