Lux et Ars
Please read these terms carefully. By using Lux et Ars you agree to the following conditions.

1) Definitions
“Platform” means the Lux et Ars website and services.
“Artwork” means images or media listed or sold on the Platform.
“AAML” means the AI Artwork Master License, which is the sole license model used for sales and transfers on Lux et Ars.
“Print” means the corresponding physical, museum-grade fine art print associated with a sale or recorded in the
License Record/Certificate (where applicable).
“Certificate” means the digitally signed document issued per sale and/or transfer documenting provenance, ownership and license data.
“Exclusive Listing” means an Artwork explicitly marked as “Unique/1/1”, “Exclusive”, or equivalent on the Platform.
“Resale Custody Service” means the Platform-managed holding and verification workflow for linked physical Prints
during a resale process to reduce fraud and ensure correct transfer of provenance.
2) Eligibility & Use
You must be at least 18 or have parental consent and the legal capacity to agree. By accessing or using the
Platform you accept these Terms. If you do not agree, do not use the Platform.
3) Intellectual Property & Licensing

Your warranties.
You warrant you own or hold all rights necessary for anything you upload and that it doesn’t infringe privacy,
publicity, trademark, or other rights.

Platform license to host & promote.
You grant Lux et Ars a worldwide, non-exclusive, royalty-free license to host, display, and promote your listings
and related previews for operating and marketing the Platform.

AAML (sole license model).
All Artwork sold on the Platform is licensed to buyers exclusively under AAML, as documented in the applicable
License Record/Certificate. AAML sets out the scope of permitted use, commercialization, exclusivity (where applicable),
and transfer rules. See

Copyright uncertainty.
Users acknowledge that the availability and scope of copyright protection for AI-assisted or AI-generated works
may vary by jurisdiction. Regardless of statutory protection (if any), AAML provides a contractual framework for
usage rights between seller and buyer to the fullest extent permitted by law.

No blanket copyright assignment.
Unless expressly stated in a listing or separate agreement, transactions grant license rights under AAML;
they do not transfer any underlying copyright or moral rights.

Transfer only via the Platform.
Licenses can be transferred only via the Platform so provenance and Certificates update correctly.
External or off-platform transfers are not supported and may be treated as invalid for Platform records.

Exclusive listings (Unique/1/1).
Where an Artwork is listed as an Exclusive Listing, the seller agrees not to offer the same Artwork,
the same edition, or any substantially identical version for sale on other marketplaces, websites,
or private storefronts for the duration of the listing on Lux et Ars.

Removal obligation after sale of exclusives.
After a successful sale of an Exclusive Listing, the seller must promptly remove any external sales listings
of the Artwork and must not re-list or resell the same exclusive edition outside the Platform.
Publicly accessible copies intended for sale (including identical download offers) must be taken down.
Private working files, drafts, or process documentation may be retained.

Integrity of exclusivity.
Attempts to circumvent exclusivity through minor alterations, mirrored versions, upscales,
or near-identical variants may be treated as a breach of these Terms and of the AAML framework.

Mandatory Print transfer on resale (where a Print exists).
If an AAML license is resold on Lux et Ars and the License Record/Certificate links a corresponding physical Print,
the Print must be included in the resale and transferred to the new license holder.
A resale that attempts to separate the license from its linked Print may be rejected or treated as incomplete.
4) Sales, Auctions & Bids
- Placing a bid or clicking Buy Now creates a binding obligation under the listing terms.
- Payments must be completed within the stated time. We may cancel or suspend transactions suspected of fraud or
rule violations.
- Listing accuracy is the seller’s responsibility. Bid retractions may be unavailable.

Resale handling for linked Prints.
For resales involving a linked physical Print, Lux et Ars may require the Print to be sent to the Platform
prior to finalizing the buyer’s payment and license transfer, or may apply comparable verification steps.
5) Certificates & Verification
Each sale issues a digitally signed Certificate containing license and owner/edition data.
Verify authenticity via your account. The Certificate is part of provenance and must accompany any transfer.
6) Fees, Commission & Taxes

Where applicable, value-added tax is applied (e.g., 19% VAT in Germany for eligible transactions).
Final amounts are shown at checkout or on invoices.

Users are responsible for any additional taxes, duties, or reporting obligations in their jurisdiction.
7) Upload Rules & Moderation
- No unlawful content, harassment, or violations of privacy, publicity, or IP rights.
- No use of protected logos/marks without permission; no deceptive portrayals of persons.

Keep a clear process record (prompts, edits, intermediates) where required by the listing format or verification
flow to support authorship and provenance claims under AAML.

For Exclusive Listings, sellers must ensure that no parallel sales offers exist outside Lux et Ars
for the same Artwork or substantially identical versions.
- We may remove content, pause sales, or limit accounts for policy violations or legal requests.

8) Prints, Bundles & Shipping

Premium Museum Fine Art Prints may be offered; bundles combine digital file, print, and certificate where indicated.

Printing and shipping costs are paid by the buyer; tracking/invoices are provided.

Damage claims require prompt notice and photos of item and packaging.

Resale Custody Service for Prints.
To reduce fraud and protect both parties, Lux et Ars may require that a Print linked to an AAML resale
be shipped to the Platform first. The Platform will hold the Print until the buyer’s payment is confirmed.
After confirmation, Lux et Ars will dispatch the Print (and where applicable the accompanying authenticity materials)
to the new license holder.

Condition responsibility.
Sellers must ensure that the Print submitted for resale matches the recorded edition and is in the condition
described in the resale listing. Material mismatches may result in cancellation, account measures, or other remedies.
9) Accounts, Tiers & Termination

Compare features/limits on

You may upgrade or cancel renewal there; benefits continue until term end.
- You’re responsible for safeguarding login credentials and account activity.

You can initiate self-deletion from settings (subject to legal retention duties).
We may suspend or terminate access for violations.
10) Privacy & KYC/AML

We process personal data per our
Privacy Policy
and
Cookie Policy.

For higher-value purchases or payouts we may request identity verification to comply with KYC/AML obligations.
- Do not include sensitive personal data in prompts or listing metadata.
11) Disclaimers & Limitation of Liability
AS IS. The Platform is provided “as is” and “as available” without warranties of any kind.
To the extent permitted by law, Lux et Ars is not liable for indirect, incidental, or consequential damages.
For users who are not consumers, total liability for simple negligence is limited to the fees you paid to Lux et Ars
for the Services in the three months preceding the claim. This cap does not apply to injury to life, body, or health,
intent, gross negligence, or mandatory product liability. Consumer statutory rights remain unaffected.
This section does not limit liability that cannot be excluded under applicable law.
12) Changes to Services & Terms
We may update Services and Terms. Material changes will be announced in-product or by notice.
Continued use after changes means you accept the updated Terms.
EU consumers: for digital content not supplied on a tangible medium, the statutory right of withdrawal may be
waived once delivery/performance starts with your express consent.
13) Governing Law & Venue
These Terms are governed by the laws of Germany. Mandatory consumer protection rules of your country of residence
remain unaffected. For consumers, statutory venues apply. For merchants, the exclusive venue is Fulda, Germany,
unless mandatory law provides otherwise.
